DMCA Copyright Policy

1. Policy Statement

Viewr.me respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, we will respond expeditiously to claims of copyright infringement committed using our Platform.

This policy outlines the information that should be present in notices of alleged copyright infringement and counter-notices. It is our policy to:

• Remove or disable access to material that is claimed to be infringing
• Terminate repeat infringers in appropriate circumstances
• Accommodate and not interfere with standard technical measures used by copyright owners

2. Copyright Infringement Notification

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Platform, you may notify our copyright agent as set forth below.

2.1 Required Information

Your DMCA notice must include the following:

• Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
• Identification of the infringing material: A description of where the material you claim is infringing is located on the Platform (including specific URLs or identifiable links).
• Your contact information: Your full name, address, telephone number, and email address.
• Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Physical or electronic signature: Your physical or electronic signature (typing your full name is sufficient).

4. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

• Remove or disable access to the allegedly infringing material expeditiously
• Notify the content uploader that we have removed or disabled access to the material
• Provide the uploader with a copy of the DMCA notice
• Terminate accounts of repeat infringers in appropriate circumstances

5. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent.

5.1 Required Information

Your counter-notice must include:

• Your physical or electronic signature
• Identification of the material that was removed or disabled and the location where it appeared before removal
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Viewr.me may be found
• A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

5.2 Response to Counter-Notification

Upon receipt of a valid counter-notification:

• We will forward the counter-notice to the original complainant
• We will inform them that we will restore the content in 10-14 business days
• We will restore the content unless the complainant files a court action seeking a court order

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

• First infringement: Warning and content removal
• Second infringement: Temporary account suspension (30 days)
• Third infringement: Permanent account termination

We may also terminate accounts at our sole discretion for a single egregious act of infringement.

7. False Claims

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake may be subject to liability.

We reserve the right to:

• Terminate accounts that submit false DMCA notices
• Pursue legal action for fraudulent claims
• Seek damages and attorney's fees
• Report bad faith actors to appropriate authorities

8. Content Creator Responsibilities

All creators on Viewr.me must:

• Own the copyright to all uploaded content, or have explicit permission from the copyright owner
• Not upload content that infringes on any third party's intellectual property rights
• Not upload content featuring individuals without their consent
• Maintain records proving ownership or permission for uploaded content
• Promptly respond to copyright inquiries

By uploading content, you represent and warrant that you have all necessary rights and that your content does not infringe any intellectual property rights.

9. Non-Consensual Content

In addition to copyright infringement, we prohibit non-consensual intimate images (revenge porn) and will remove such content immediately upon notification. To report non-consensual content:

• Email: abuse@viewr.me
• Include URLs of the offending content
• Proof of identity (if you are the subject)
• Statement that content was published without your consent

10. Trademark Infringement

If you believe content on our Platform infringes your trademark rights, please contact us with:

• Description of your trademark
• Registration number (if registered)
• Location of the infringing use
• Explanation of why the use is confusing or misleading

11. International Copyright

We comply with copyright laws globally. If you believe content infringes copyright under laws outside the United States, you may submit a notice following the same format as the DMCA notice, noting the applicable jurisdiction and laws.

12. Processing Time

• DMCA takedown notices: Processed within 24-48 hours
• Counter-notifications: Reviewed within 5 business days
• Content restoration: 10-14 business days after counter-notice (if no court order)
• Urgent cases: Expedited processing available for legal emergencies

13. Limitations

Please note:

• We are not responsible for determining whether content is actually infringing
• We act as a service provider and rely on notices from copyright holders
• Removal of content does not constitute legal advice or judgment on copyright status
• Disputes should ultimately be resolved between the parties involved

14. Changes to This Policy

We may modify this DMCA Policy at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the updated policy.
